OPEN LETTER TO ALL PRO-CHOICE ACTIVISTS
We think the proposed South Dakota abortion ban may be a real opportunity for us .
But to assure it helps and doesn't hurt the women of America , we need your help.
Ok you may be asking, have they lost their minds ? How can a total abortion ban, except to save the life of a mother be a good thing for us? Let us continue:
First , the people of South Dakota will vote to overturn this law if we can help them qualify a statewide voter initiative and then go on to defeat this legislation at the ballot box this November. Having a statewide vote on this would send a dramatic and strong message to all the other anti-choice legislatures who are considering copycat bills. It will likely stop them dead in their tracks….
Second , even if this ban does make it past the state level and find its way up past the Federal Court and into the Supreme Court -- this Supreme Court will vote the ban down. It is a direct assault on Roe. We predict that the vote will either be 5-4, (Kennedy will vote to uphold) or we think it will more likely be 6-3, with Justice Roberts also joining the pro-choice side.
We have always maintained, based on our research, that Justice Roberts is likely to be with us to uphold the basic premise of Roe. He would see his vote to overturn as too disruptive to women in today's society. But even if he votes wrong we are okay.
There is great benefit if the South Dakota ban makes it to the Supreme Court and is voted down -- that would create one more layer of recent Supreme Court precedent which would make it even harder for the Supreme Court to overturn Roe in the future.
It is that latter point that explains why some national “pro-life” groups are not happy with what the South Dakota legislators have done. They understand what I am saying will be true . They have been chicken to have a frontal assault on Roe.
If they weren't afraid of the consequences, they would have pushed their Far Right
friends in Congress to vote on the so-called Human Life Amendment that is introduced by the antis in Congress each session. This bill calls for an amendment to the U.S. Constitution and would create a South Dakota type ban in all 50 states.
Instead of pushing that bill in the U.S. Congress, each year when it is introduced, it is quickly referred to committee and buried at the committee level. The antis don't even try to get it out on the floor for a vote. They run from this up and down vote on Roe.
Odd don't you think? How can that be explained? Very simply really….
The antis in Congress don't want a frontal assault on Roe because they know the public debate, on what this ban would really mean to women and their families, would destroy their movement. Strong words ?
Well, how do you think the women of America would react to having most of their birth control outlawed ? That consequence would be triggered by the ban since most major forms of birth control, like birth control pills, are abortifacient.
And how do you think the police would enforce this abortion ban?
Let us give you a likely scenario based on recent history.
The most recent case of a strict abortion ban like this took place in Romania in the 1980's. How did they enforce the ban? They created a National Registry of Pregnant Women. That's right. In Romania, when it was determined that you were pregnant, they would put you on a national list… and in 9 months you better have a baby or proof that you had a natural miscarriage -- or you and your doctor would risk going to jail.
Think about it, this is the only way the South Dakota Ban could be enforced.
Just imagine how that would go over with the women and doctors of America !!
So you can see why some of the “pro-life” groups are not happy with South Dakota . These antis like having the possibility of a complete overturn of Roe out there to whip up their troops without delivering on the promise .
We really think the so-called “pro-life” legislators in South Dakota have over- played their hand this time and made a fatal mistake in strategy .
